EPLI Self-Rater Makes Binding Coverage Simple

IIABCal member agents and brokers have access to an exclusive Employment Practices Liability program through CRC Group and underwritten by Houston Casualty Company, A.M. Best Rated A+ XIV, a non-admitted company in California.  The program offers low retentions starting at $5,000, wage & hour coverage, affordable pricing, broad coverages, self-rater (if it fits, it binds), simple 16-question application form, free human resources services through HR Pilot, and 10% commissions.

Qualification Requirements:

  • No claims or incidents past three years
  • 100 or fewer employees
  • Employee applications containing “At Will” disclosure
  • Employee handbook must be in place to bind coverage (not required to be sent with submission)
  • Original ink signature NOT required to be sent with submission

2022 Policy Changes

  • 5% increase in premium for employee count brackets 1-45
  • 1% increase in premium for insurance agencies
  • Pharmacies, valet parking, and artists added to excluded classes of business.  Renewals in this class of business will be non-renewed.
  • Data Privacy Wrongful Act Exclusion Endorsement added
  • Additional question in the claims Section (C #4)

Program Highlights: 

  • Available coverage limits of $250,000, $500,000 and $1 million
  • Full "Prior Acts" coverage is included for accounts with prior EPLI coverage
  • Insures the entity as well as all employees, including part-time, temporary, leased (if indemnified), seasonal and independent contractors (by endorsement)
  • Contains a "Duty to Defend" provision, and is on a “pay on behalf of” basis
  • Broad coverage language for employment related claims such as discrimination, harassment, wrongful termination, hostile work environment, failure to hire or promote, wrongful demotion, negligent evaluation, deprivation of career opportunity, retaliation, wrongful discipline, etc
  • No Intentional Acts or Downsizing exclusions
  • Effective January 1, 2019, California employers with 5 or more employees are required to provide:

    • 1 hour of sexual harassment and bullying prevention training to all nonmanagerial employees.

    • 2 hours of sexual harassment and bullying prevention training to all supervisory employees.

    • Training must be completed no later than December 31, 2020.
