Attorney General Becerra Releases Draft CCPA Regulations

California Attorney General Xavier Becerra this Thursday released his agency’s draft regulations on the California Consumer Privacy Act (CCPA). The proposed regulations would establish procedures to facilitate consumers’ new rights under the CCPA and provide guidance to businesses for how to comply.

In his press conference, AG Becerra began by citing a well-known case of a Minnesota teenager who purchased items from a Target store only then to receive coupons for cribs and maternity clothes. As a result, her father found out she was pregnant because of the coupons Target had sent to the family home.

Covering the draft regulations, AG Becerra stated there were four broad areas of restoring choice, control, transparency, and fostering innovation for the development of the new regulations. Those broad areas provided guidance for five key components of the regulations: (1) explaining how businesses are required to inform consumers; (2) how businesses must handle consumer information; (3) clarity and guidance to businesses and the public; (4) explain how businesses must handle information related to children under the age of 16; and (5) what businesses must do to not discriminate against person’s who opt-out.

As the team in the AG’s office considered past, current, and pending legislation for these regulations, they also recognized the need to balance innovation and privacy. Although there is a pending initiative to further amend the CCPA, the AG declined to comment on that as his office needs to remain neutral as it will be tasked with analyzing and drafting the official language for the initiative.

This announcement of the draft CCPA regulations is only the first step. Workshops will be held in Sacramento (12/2), Los Angeles (12/3), San Francisco (12/4) and Fresno (12/5); and public comment will be accepted until December 6.

Here is the text of the proposed regulations.


 

Public Support for Split-Roll Initiative Is Sinking, Poll Finds

The split-roll property tax issue has qualified for the November 2020 ballot but, already, it’s showing signs of failure. Based on a recent poll conducted by the Public Policy Institute of California (PPIC), only 47 percent of likely voters support the split-roll property tax measure while 45 percent outright oppose it.

Since the PPIC last polled on this measure in April, support has dropped a total of seven percentage points with likely voters.

The question asked to respondents was: “As you may know, under Proposition 13, residential and commercial property taxes are both strictly limited. What if there was a state ballot measure to have commercial properties taxed according to their current market value and direct some of this new tax revenue to state funding for K-12 public schools? Would you vote yes or no?”

Among all respondents, including those who are not likely voters, the split-roll initiative was supported by 57 percent and opposed by 34 percent, while 9 percent were undecided. The poll’s sampling error is +/- 3.2 percent.

Outlets such as Politico have suggested the initiative is facing trouble as it “has dipped below 50 percent even before facing a serious opposition campaign – and without any mention in the survey question that the initiative would alter Proposition 13, a landmark law most voters typically associate with popular residential tax protections.”

PPIC President Mark Baldassare stated, “It’s a hard place to start from, and then add in the fact that it’s easier for people to vote ‘no’ than ‘yes’ and we know there’s a ‘no’ campaign.” PPIC polls tend to find that a strong majority of voters (60 percent) support Proposition 13 as “a good thing.”

CalTax President Robert Gutierrez, who co-chairs Californians to Stop Higher Property Taxes (the campaign against the split roll), cautioned that while the poll results are good news for taxpayers, a strong opposition campaign still is needed.


 

Dynamex Déjà Vu All Over Again

In a case heard by the Second Appellate Court in California, it was ruled a strict employee classification standard known as the "ABC test" can be applied retroactively. The case being considered was Gonzales v. San Gabriel Transit, in which Francisco Gonzales alleged that San Gabriel Transit misclassified drivers as independent contractors.

The October 8 ruling means a driver who was misclassified as an independent contractor can calculate damages for lost wages, overtime wages, meal and rest break violations, and other missed benefits based on errors made by trucking companies under the newly established ABC test.

Earlier this year, the U.S Ninth Circuit then ruled that the ABC test applied retroactively (Vazquez v. Jan-Pro Franchising Int’l). This meant federal courts should apply the test to all pending claims, regardless of when the claim originated. Then in July, the Ninth Circuit Court of Appeals depublished its Vasquez opinion, relieving the federal courts from this precedent. They subsequently certified a question to the California Supreme Court asking it to determine whether Dynamex should apply retroactively.

While we have yet to see a decision by the California Supreme Court on this issue, the Second Appellate Court puts this issue in flux once again.

In the meantime, AB 5 was recently signed into law and will become effective on January 1, 2020. AB 5 codifies the ABC test outlined in the California Supreme Court's decision in April 2018 in Dynamex Operations West Inc. v. Superior Court. In order to be an independent contractor, a company must prove A) the worker is free from the control and direction of the hiring entity, B) the work performed is outside the usual course of the company's business, and C) the worker is engaged in an independently established trade or occupation. 


 

Legislation Banning “Pay for Delay” for Pharmaceuticals Signed by Governor

Building upon his promise to lower prescription drug costs, Governor Gavin Newsom signed three bills to lower the cost of prescription drugs and increase access to care for California families. These bills will block pharmaceutical companies from keeping cheaper generic medicine off the market, improve black maternal health, and expand access to PrEP and PEP HIV medications.

AB 824, authored by Assemblymember Jim Wood (Santa Rosa) and sponsored by Attorney General Xavier Becerra, makes California the first state to tackle what are known as pay-for-delay agreements to postpone the development of generic biosimilar drugs. According to a Federal Trade Commission study, these deals cost consumers and taxpayers $3.5 billion in higher drug costs every year. AB 824 prohibits these agreements between brand name and generic drug manufacturers by making them presumptively anticompetitive.

SB 464 by Senator Holly Mitchell (Los Angeles) will reduce preventable maternal mortality among black women by requiring all perinatal health care providers to undergo implicit bias training to curb the impact of bias on maternal health, and improving data collection at the California Department of Public Health to better understand pregnancy-related deaths. The 2019-20 state budget includes more than $65 million of ongoing total funds to expand the California Home Visiting Program and the Black Infant Health Program, which will improve the health and wellness of mothers and children and allow more families to access these important culturally appropriate services.

SB 159 by Senator Scott Wiener (San Francisco) authorizes pharmacists to furnish pre- and post-exposure prophylaxis (PrEP and PEP) without a physician's prescription. The bill also prohibits insurance companies from requiring prior authorizations for patients to obtain PrEP coverage. The state budget includes a one-time $40 million General Fund for infectious diseases prevention and control, and an ongoing $2 million General Fund specifically to address sexually transmitted diseases, as well as an additional ongoing $5 million General Fund for HIV prevention and control.

Actions on these three bills extend the Governor’s efforts to confront the concerns over prescription affordability for working Californians. Earlier this year, the Governor announced the counties of Los Angeles, Santa Clara, Alameda, and San Francisco, among the largest public purchasers of prescription drugs in California, will partner with the state to use their combined market power to take on drug companies and lower the cost of prescription drugs.


 

Governor’s Action on Legislation

Governor Gavin Newsom has already acted on hundreds of bills this year, 1,037 signed and 38 vetoed, with 266 still on his desk. The Constitution allows him until this Sunday, October 13 at midnight, to take action he deems necessary. Any bills remaining after that without his action are automatically to become law.
